Sale of Narcotics
Most charges for selling or delivering drugs involve an elaborate sting operation. In most of these cases, a confidential informant acts under a substantial assistance agreement to set up another individual. In some cases, the person buying the drugs is actually an undercover officer.
The target of the sting operation can be charged with a crime related to the sale of narcotics as part of the “controlled buy.” The most commonly asserted defense in these cases is the entrapment defense.
The penalties for selling drugs to another, especially when part of a sting operation, are extremely serious. In fact, the penalties for drug dealing in Florida are far more serious than the penalties for simple possession of drugs. Although charges for possession might be eligible for a diversion program, entering those types of programs is typically not an option when the defendant is accused of dealing drugs.
